The following terms and conditions apply to all use of the MARIBERT SRL website. By placing an order with us you agree to have read, understood and accepted to these terms and conditions. Please note, as these may be subject to change at any time without notice, it is your responsibility to check this page prior to any use or purchase. PRODUCTS AND ORDERS

CONFORMITY OF GOODS

The selection available on www.maribertstore.com reflects exact real-time availability of each item, by size and colour.

Every care is taken to ensure that the description, specification and pricing of all products shown on our website and in our catalogues is correct. The product information and specification provided is not binding, but is carefully considered and intended to give a general description of each product.

While the colour reproduction of each product is a close representation, we cannot accept any responsibility for any variation in colour caused by the differences in browser software.

MARIBERT SRL will act immediately to correct any error identified and are under no legal obligation to honour a price displayed in error.

Once MARIBERT SRL receives an order request it reserves the right to confirm the availability of the items purchased, as well as to verify the validity of the transaction via credit card and the details of previous transactions carried out by the Customer on www.maribertstore.com. In the event that the items ordered are not available, or that for any reason it is not possible to process the order as requested by the Customer, www.maribertstore.com will immediately notify the Customer.

PRICES AND CURRENCY

All prices quoted on this website are shown in Euro (€/EUR) without tax (VAT) and shipping cost. Tax and VAT are counted at the end of the order at the moment of filling shipping address.

In case of shipments that are made to non-European countries, no VAT is charged. As soon as the articles arrive at the destination, sales tax on imports as well as customs duties and handling costs will be determined by the respective customs office. The recipient will then be invoiced by our logistics partner DHL.

All orders shipped are accompanied by an official invoice in Euro reporting the exact total amount of the purchase as required by international commerce regulations.

The amount actually charged to the customer’s credit card account could be subject to changes due to fluctuations in exchange rates or to banking fees: for more details, we recommend that Customers contact their bank.

PLACING AN ORDER

When placing an order, you agree that all details you provide to MARIBERT SRL for the purpose of purchasing goods are accurate and complete in all respects.

Your contract for purchases made through www.maribertstore.com is with MARIBERT SRL.

By submitting your order and paying and/or submitting the required information, you agree to the import regulations of the respective articles. Please be aware that import regulations vary from country to country. Please note that customs duties, sales tax on imports, as well as handling costs that were charged to the recipient by DHL or EMS by order of the customs office, cannot be refunded by www.maribertstore.com even in the case that the articles should be returned.

It is not possible to request amendments to orders that have already been processed. Further orders added shall be handled and shipped separately.

Orders placed may be declined or cancelled in the event of Products being out of stock, damaged Products, incorrect Product information, incorrectly displayed prices, and due to payment for Products not being received or payments not being authorized by MARIBERT SRL.

We will notify you as soon as we can if any Items Ordered are not available.

III.GIFT CARD/PROMOTION CODE

Simply go to “shopping bag” and enter your Gift Card code/coupon code in the designated field. If the order amount exceeds the balance on your Gift Card or the amount from the promotion, please select the payment method with which you wish to cover the remaining amount. If the balance on your Gift Card or the amount from the promotion exceeds the order amount, you may use the same code for your next purchase. The amount remaining will be available until your credit balance has been used up completely.

MARIBERT SRL reserves the right to block the Gift Card if misused.

Please note also that, regardless of the payment method selected, the products ordered shall remain the property of MARIBERT SRL until the relative price is cashed in full.

SHIPPING METHODS AND COST

SHIPPING IN ITALY

Standard deliveries to Italy are free of charge and are operated by DHL.

Orders are delivered Monday-Friday between the following hours: 08.30am to 05.45pm.

SHIPPING TO THE REST OF THE WORLD

All orders are shipped worldwide via courier DHL.

Shipment and deliveries are free for order more than € 500, for all other orders a contribution for shipping is required.

Delivery fees vary depending on your selected delivery option and Items ordered. Delivery options and costs are calculated per item and in accordance with the location of your delivery address. The delivery fee will be displayed during the ordering checkout process, but before checkout has been finalized.

Every shipment outside the European Union will be DAP (Delivery at Place) so please be aware that sales taxes, customs duties, and handling costs will be charged by DHL on an individual basis directly upon shipment as far as non-European Union (EU) countries are concerned, and will not be refunded by MARIBERT SRL in case the articles are returned.

US IMPORTER REQUIREMENTS

Private U.S.A. citizens and non-U.S.A. citizens residing in the U.S.A. that import from abroad following online purchases are considered final importers: they must have and release to the courier/broker a SSN – Social Security Number or, if they’re non-U.S.A. citizens, a CBP – Customs Border Protection Number. The process to request and obtain a CBP takes around 14 working days.

If the package cannot be cleared and delivered due to Customer’s responsibility in non-compliance of import requirements (wrong telephone number and address, SSN or CBP numbers not provided) the package will be sent back to Italy at the Customer’s expense, that includes shipping and import fees: this expense will be deducted from the final reimbursement.

SHIPPING DOCUMENTS

As required by the international laws governing imports and exports, all orders are shipped with an official invoice declaring the truthful total amount of the merchandise purchased. According to international law, it is illegal to understate the value of purchased items or to declare an item as GIFT.

TAXES

Delivery times

Once the order is processed and fulfilled, shipping times are as follows:

• Italy, Europe EU: 1-3 working days
• USA, Canada and Japan: 2-4 working days
• Non-EU Europe and Rest of the world: 4-7 working days
• Russian: 7-15 working days

The times indicated refer to shipping into main cities. Delivery times are approssimative and may vary due to factors that are outside the responsibility of MARIBERT SRL. We kindly ask Customers to provide a valid address where the goods can be delivered during delivery times. Any delivery delays must be immediately notified to our Customer Service.

ORDER DELIVERY

At the time of receiving the package, we kindly ask Customers to carefully check it before signing for delivery. The goods become property of the customer at the moment of the signature is appended.

The following may occur:

• At the time of delivery, the package appears obviously tampered/damaged: we advise Customers to sign subject to checking/verification or to refuse delivery.
• Customer refuses delivery of shipment or asks for it to be returned to sender: any redelivery cost that may be charged to MARIBERT SRL.will be subtracted from any refund due to the Customer.
• Impossible to deliver the shipment to the address provided by the Customer in the commercial contract: the package may be returned to the sender. All redelivery/return expenses will be borne by the Customer and will be subtracted from any refund due to the Customer.

RETURNS

CUSTOMIZED PRODUCTS

All customized items can’t be returned. It is possible to return only if there is a specific mistake of MARIBERT SRL. The conditions and procedure for this are as follows.

Please note: we can only accept returns from the same country where the order was originally shipped.

NON-CUSTOMIZED PRODUCTS

For non-customized products, after communicating the desire to return the goods, you have 14 days to return the products to MARIBERT SRL. After this period of time, no returns are accepted.

In the presence of an error attributable to MARIBERT SRL the shipping costs and the booking will be arranged by MARIBERT SRL. If the error is attributable to the Customer, the return shipping costs will be deducted from the refund (if requested with the courier of MARIBERT SRL and not with your own).

The refund will be made in any case once the goods have been received.

The goods received must not be damaged or with missing parts. The goods should be returned in the original packaging. If one or more of these conditions are not met, MARIBERT SRL will not make the refund and MARIBERT will provide to return the goods to the Customer at the recipient’s expense.

In the latter case, if the goods are not accepted, the courier has indications to destroy the package and there will be no refund.

Returns are accepted only from the country to which the goods were originally delivered.

RETURNS CONDITIONS

Products shall be returned in the original packaging and in the same conditions in which they were originally sent: unworn, not washed or altered. Moreover, returns shall be returned equipped with all original accessories.

RETURNS PROCEDURE

Return authorization can be requested within 14 days from the date of delivery.

Shipping must take place within 7 working days from the date of authorisation. Within 3 working days from receiving the returned goods MARIBERT SRL. shall send a confirmation e-mail accepting the returns.

MARIBERT SRL reserves the right to inspect the returned product and, if they do not comply with the relevant conditions, to return them at the cost of the purchaser.

REFUNDS

Where a refund has been requested, this shall apply to the price only and not to shipping costs (both delivery and return) and customs duties (if any).

MARIBERT SRL shall endeavour to carry out the refund immediately, in any case within 14 working days from the date of accepting the returns: the actual date of the credit appearing on the Customer’s statement may vary due to factors that are outside the responsibility of MARIBERT SRL.

By default, refund are made on the same payment method used by the Customer for payment.

FAULTY MERCHANDISE

Products received already damaged or that manifest a patent defect are considered as faulty.

MARIBERT SRL reserves the right to refuse unauthorised faulty returns.

In the event that a faulty return is accepted, MARIBERT SRL shall refund the purchase price, shipping costs and customs duties. In the event that the original shipment took place as a DAP, with duties and taxes paid at destination, such amounts shall be refunded if, included in the return package, the relevant documentation is sent to MARIBERT SRL.

RETENTION OF TITLE
